AEDH and Otwarta Rzeczpospolita denounce the Polish Government’s silence on the recent discriminatory comments and acts

AEDH and Otwarta Rzeczpospolita are concerned about the infringement of equality and human rights which recently occurred in Poland and the indulgent reaction of the Polish authorities on this subject. 

In a recent statement the Polish Minister for Equal Treatment declared that it was justifiable for Catholic schools to fire homosexual professors based solely on their sexual orientation, therefore supporting discriminatory practices based on sexual orientation. Following this statement, at the very least problematic coming from a minister of equality, the highest State authorities did not denounce this behaviour. In addition to this incident, Polish authorities have turned a blind eye to acts of discrimination and xenophobic statements. The Polish police therefore decided to close an investigation on an anti-Semitic inscription, the reason being that according to only the interrogation of the perpetrator, in which he claimed that he had no intention to offend anyone, the inscription was not an offence. 

It should also be reminded that in March 2010 the European Court of Human Rights charged Poland with discrimination based on sexual orientation, committed by a Polish municipality(1), and that an action was taken by the European Court of Justice in May 2010 against Poland for incorrect implementation of European law(2). AEDH and Otwarta Rzeczpospolita would like to emphasize that by entering in, and being part of, the European Union, Polish authorities have committed themselves to respect common values and rules and to apply them as any other Member State. 

Acts of discrimination are in fact still common in Poland, based largely on ethnic origins, sexual orientation and religion, in spite of the creation of a ministry for equal treatment, and the implementation of a program to fight against racial discriminations between 2004 and 2009. These measures have shown their lack of efficiency when the Polish public authorities are silent and therefore supportive of discriminatory public statements, and ignore acts of discrimination related to the dignity of different social groups, which should be protected by the State.

AEDH can thus only express its solidarity and support for Polish civil society organizations that denounce discriminatory acts committed by public authorities. They must be listened to.  

AEDH and Otwarta Rzeczpospolita reassert their commitment to the fight against all forms of discrimination and ask the highest Polish authorities to choose action over words, condemnation over silence, and to efficiently fight against discrimination and xenophobia. There is a need for a strong commitment of the Polish government in order to respect values that are common to all EU citizens and States and guaranteed by the Treaties and the Charter of Fundamental Rights.

AEDH i Otwarta Rzeczpospolita zgałszają milczenie rządu polskiego na temat niedawnych aktów dyskryminujących

AEDH i Otwarta Rzeczpospolita wyrażają niepokój wobec niedawnych naruszeń zasad równego traktowania jak i praw Człowieka w Polsce, a także wobec przymykania oczu na te fakty przez władze polskie.

W jednym z ostatnich oświadczeń,  polska Pełnomocniczka Rządu do Spraw Równego Traktowania uznała za uzasadnione zwalnianie z pracy przez szkoły katolickie nauczycieli homoseksualistów jedynie na podstawie ich orientacji seksualnej, wyrażając tym samym aprobatę dla praktyk dyskryminacyjnych ze względu na orientację seksualną. W konsekwencji tego oświadczenia, co najmniej zaskakującego ze strony Pełnomocniczki do Spraw Równego Traktowania, najwyższe władze Państwa nie uczyniły nic ani nie potępiły tego typu stanowiska. Ponadto inne przejawy dyskryminacji czy oświadczenia ksenofobiczne są ignorowane przez polskie władze. Dla przykładu, polska policja zamknęła śledztwo w sprawie antysemickiego napisu argumentując brakiem przestępstwa wyłącznie na podstawie zeznania sprawcy napisu, który oświadczył, że nie miał intencji wyrządzenia szkody.

Nie trzeba zresztą przypominać, że w marcu 2010 Europejski Trybunał Praw Człowieka skazał Polskę za dyskryminację osoby homoseksualnej przez władze jednego z miast(1), oraz że w maju 2010 Komisja Europejska wszczęła sprawę przeciwko Polsce w Trybunale Sprawiedliwości Unii Europejskiej za nieprawidłowe wdrażania prawa europejskiego.(2) AEDH i Otwarta Rzeczpospolita podkreślają przeto z naciskiem, że przystępując do Unii Europejskiej i jako jej członek, polskie władze zobowiązały się do poszanowania wartości i wspólnych unijnych reguł oraz do ich stosowania w taki sam sposób jak każde inne Państwo członkowskie.

Przejawy dyskryminacji – szczególnie ze względu na pochodzenie etniczne, religię, orientację seksualną – są nadal szeroko rozpowszechnione w Polsce i to pomimo utworzenia ministerstwa do Spraw Równego Traktowania oraz wprowadzania w życie programu zwalczania przejawów dyskryminacji rasowej w latach od 2004 do 2009. Instytucje te okazują się mało efektywne skoro władze polskie milcząc popierają dyskryminacyjne oświadczenia publiczne, nie rozpoznają przejawów dyskryminacji raniących godność różnych grup społecznych, którym Państwo powinno zapewnić bezpieczeństwo.

AEDH wyraża w pełni swą solidarność i poparcie dla wszystkich organizacji polskiego społeczeństwa obywatelskiego, które ujawniają przejawy dyskryminacji ze strony władz publicznych. Głos tych organizacji musi znaleźć odzew.

AEDH i Otwarta Rzeczpospolita przywiązują ogromną wagę do zwalczania wszelkich form dyskryminacji. Żądają one od najwyższych władz polskich konkretnych poczynań a nie słów, potępiania dyskryminacji a nie przymykania nań oczu, jak również żądają niezłomnego i skutecznego zwalczania dyskryminacji i ksenofobii. To wymaga zdecydowanego zobowiązania się polskiego rządu na rzecz poszanowania wartości wspólnych wszystkim obywatelom i krajom Unii Europejskiej, wartości, o których jest mowa w traktatach Unii i w Karcie Praw Podstawowych.

L’AEDH et Otwarta Rzeczpospolita s’inquiètent des atteintes à l’égalité de traitement et aux droits de l’Homme commises récemment en Pologne et de l’attitude complaisante des autorités polonaises à ce sujet. 

Dans une récente déclaration la ministre polonaise pour l’égalité de traitement a affirmé qu’il était justifié que des écoles catholiques renvoient des professeurs homosexuels sur le seul fait de leur orientation sexuelle, cautionnant par là même des pratiques discriminatoires en fonction de l’orientation sexuelle. Les plus hautes autorités de l’Etat à la suite de cette déclaration pour le moins surprenante venant d’une ministre de l’égalité, n’ont rien fait et n’ont pas dénoncé un tel comportement. Outre cet évènement, les autorités polonaises ont fermé les yeux sur des actes de discriminations ou sur des déclarations xénophobes. Ainsi la police polonaise a décidé de clore une enquête sur une inscription antisémite, au motif que l’inscription ne constituait pas un délit en se basant sur le fait que l’auteur de l’inscription avait affirmé ne pas avoir eu l’intention de nuire. 

Faut-il aussi rappeler qu’en mars 2010, la Pologne a été condamnée par la Cour européenne des droits de l’Homme pour discrimination commise par une municipalité polonaise à l’encontre d’une personne homosexuelle(1), qu’une action de la Commission européenne a été engagée auprès de la Cour de Justice en mai 2010 à l’encontre de la Pologne pour transposition incorrecte du droit européen.(2) L’AEDH et Otwarta Rzeczpospolita ne peuvent que souligner avec force qu’en entrant et en faisant partie de l’Union Européenne les autorités polonaises se sont engagées à en respecter les valeurs et les règles communes et à les appliquer comme tout autre Etat membre. 

Les actes de discrimination sont toujours largement répandus en Pologne, actes basés notamment sur l’origine ethnique, l’orientation sexuelle ou la religion et ceci malgré la création d’un ministère pour l’égalité de traitement et la mise en place d’un programme de lutte contre les discriminations raciales de 2004 à 2009. Ces dispositifs montrent leur peu d’efficacité quand les autorités publiques polonaises cautionnent par leur silence des déclarations publiques discriminatoires, ignorent  des actes de discrimination touchant à la dignité de groupes sociaux qui pourtant devraient recevoir une protection de l’Etat. 

L’AEDH ne peut qu’exprimer sa solidarité et son soutien aux organisations de la société civile polonaise qui dénoncent ces actes discriminatoires commis par des autorités publiques. Elles doivent être entendues. 

L’AEDH et Otwarta Rzeczpospolita réaffirment leur attachement à la lutte contre les discriminations sous toutes ses formes. Elles demandent aux plus hautes autorités de l’Etat polonais des actes et non des paroles, la condamnation et non le silence, et de lutter contre les discriminations et la xénophobie de façon déterminée et efficace. Cela nécessite un engagement fort du gouvernement polonais pour que soient respectées les valeurs communes à l’ensemble des citoyens et pays de l’Union Européenne, valeurs reprises dans les traités de l’Union et la Charte des droits fondamentaux.
