[fse-esf] call for solidarity with conscientious objector Ismail Saygi, arrested by Turkish military forces

On November 26, 2006 Ismail Saygi declared his conscientious objection with
these words: "During the seven months I served at the military, I realized
that the ideologies of violence, of dying and killing did not fit in my
lifestyle and my view of life. During these seven months that I served as a
soldier, I began to lose my self-respect and psychological well-being.
Because of these reasons I decided that I shall not have any connection with
any institution or association which involves violence whatsoever." Whilst
leading his life under the immediate threat of death like all the
conscientious objectors living in Turkey, Ismail was taken into custody on
March 16, 2008 in the Kadıköy district of Istanbul on the grounds of being a
deserter. After being delivered by the police forces to Üsküdar Military
Police Station and held there for a day, Ismail was sent to Selimiye
Military Attorney in order to give his statement and then was brought to
trial in Selimiye Military Court which consequently arrested him. Ismail
Saygi stated both in the military attorney and court that he was a
conscientious objector, that he wanted to use his right of conscientious
objection granted by international law and that he would not complete the
rest of his military service. We presume that Ismail will be transferred
under custody to the closest military prison to Kars-Kağızman where he was
doing his military service before, namely to Sarıkamış Military Prison
within few days.

We are concerned that Ismail will also be subjected to arbitrary oppression,
restrictions, disciplinary punishments and torture which other conscientious
objectors had to endure in military prisons in the past. In January 2006 the
judgement of Turkish authorities' conviction by the European Court of Human
Rights had caused significant public upheaval. It was stated in the
declaration presented by the Turkish authorities to European Commission
Cabinet Government in June 2007 that legislation was being prepared in order
to prevent conscientious objectors being tried according to the Military
Criminal Law. The period of non-action since that time and Ismail's arrest
prove that the decisions of the European Court of Human Rights and the
recommendations of the European Commission Cabinet Government are being
ignored by Turkey.

Solidarity with Ismail Saygi Initiative was formed in İstanbul after
Ismail's arrest. The initiative organized a press release on Wednesday,
March 19, 2008 at Galatasaray Square with approximately 40 participants and
expressed their owning of and support to Ismail's conscientious objection.
Conscientious Objection Initiative in Cyprus has also announced that they
will continue giving support until Ismail is released.

We state that Ismail Saygi is not a soldier but a conscientious objector and
demand his release immediately. We are looking forward to receiving your
support from Barcelona, Pyongyang, Amsterdam, Sydney, Toronto, Jerusalem,
Santiago, Athens and wherever you are in the world in order to raise our
voices even louder together.

Le 26 Novembre 2006 Ismail Saygi a ainsi déclaré son objection de
conscience: « Pendant les sept mois que j'ai servi dans l'armée, je me suis
rendu compte du fait que la logique de violence, de mourir et de tuer du
service militaire ne correspond point à mes vues et mon style de vivre.
Pendant ces sept mois que j'ai servi comme soldat, j'ai commencé à perdre ma
dignité et ma santé psychologique. À cause de ces raisons j'ai décidé de ne
pas avoir des relations formelles ou informelles avec les institutions et
les associations qui impliquent la violence. » En menant sa vie sous le
menace immédiat de mort comme tous les objecteurs de conscience vivant en
Turquie, Ismail a été détenu le 16 Mars 2008 à Kadıköy, Istanbul en raison
d'être un déserteur. Après être apporté par la police au Commissariat
Militaire d'Üsküdar et y détenu pendant un jour, Ismail a été envoyé au
Procureur Militaire de Selimiye pour qu'il ait fait sa déclaration et puis
apporté au Tribunal Militaire de Selimiye qui l'a ensuite arrêté. Ismail
Saygi a affirmé au Procureur Militaire ainsi qu'au Tribunal Militaire qu'il
était objecteur de conscience, qu'il voulait utiliser son droit d'objection
de conscience accordé par la loi internationale et qu'il ne complèterait pas
le reste de son service militaire. Nous croyons qu'Ismail sera transféré
sous détention dans quelques jours à la prison militaire la plus proche à
Kars-Kağızman où il faisait son service militaire avant, à savoir la Prison
Militaire de Sarıkamış.

Nous nous inquiétons qu'Ismail serait aussi soumis aux oppressions
arbitraires, restrictions, punitions disciplinaires et à la torture que les
autres objecteurs de conscience ont dû subir dans les prisons militaires
dans le passé. En Janvier 2006 la condamnation des autorités turques par la
Cour Européenne des Droits de l'Homme avait bouleversé l'opinion publique.
En Juin 2007 les autorités turques ont déclaré à la Commission Européenne
que la législation était en train d'être préparée pour l'empêchement du
traitement des objecteurs de conscience selon la Loi Criminelle Militaire.
Depuis ces jours-là, la période relevant la négligence concrète des
autorités contrairement à cette déclaration non-action depuis et
l'arrestation récent d'Ismail prouvent que les décisions de la Cour
Européenne des Droits de L'Homme et les recommandations de la Commission
Européenne sont ignorées par la Turquie.

L'Initiative pour la Solidarité avec Ismail Saygi a été établie à İstanbul
après l'arrestation d'Ismail. L'initiative a organisé une communiqué de
presse mercredi le 19 Mars 2008 à la Place de Galatasaray avec à peu près 40
participants et a exprimé leur reconnaissance de et leur soutien à
l'objection de conscience d'Ismail. L'Initiative de l'Objection de
Conscience en Chypre a aussi annoncé qu'ils allaient soutenir Ismail jusqu'à
sa libération.
Nous affirmons qu'Ismail Saygi n'est pas un soldat mais un objecteur de
conscience et demandons qu'il soit immédiatement libéré. Nous attendons
votre soutien de Barcelona, Pyongyang, Amsterdam, Sydney, Toronto,
Jerusalem, Santiago, Athènes et de partout dans le monde pour élever nos
voix encore plus fort tous ensemble.
