Political immigrants are under threat
Though priorities vary from country to country, Turkish and Kurdish immigrant labourers are the primary target of the attacks in Germany. Those attacks that are practiced with consulting the collaborate fascist Turkish state to deport the political immigrants have reached a new scope. Many political immigrants have been taken into custody on grounds of Turkeys demand for restitution. These people had to leave their country because they were subject to state terror for their political activities, and because investigations were opened and they were penalised.
From the point of view of the fascist rationale the desire of the Turkish state to punish these people is understandable. But the fact that this is also a demand of the German state is being ignorant to the UN Geneva Convention which it has signed. This shows how the conventions signed among states turn into scraps when mutual benefits of the parties are concerned.
Therefore, the reassurance of the labourers and workers are their awareness of their own problems and taking a position against the attacks. Since the beginning of the year, Yusuf Karaca, Süleyman Şahin, Zeynep Yeşil, Önder Dolutaş, Muzaffer Ayata, Erdoğan Elmas, Veysel Çınar, Mehmet Eşiyok who are political immigrants have been taken into custody. The claimed reason was that there had been a restitution demand. Recently, Binali Yıldırım was arrested in Spain and Binali Soydan who applied Köln Foreigners Office to extend his residence was also arrested. Both were arrested to be deported.
Germany Wants Qualified Immigrants
In Germany, the amendments required by the government in relation to the Act of Immigration which was put into practice two years ago, were accepted by the Federal Congress on June 15th, 2007 and were discussed and confirmed by State Congress on July 6th, 2007.
Ministry of Home Affairs, Wolfgang Schaeuble defended the act claiming that it would make integration easier and said 2nd and 3rd generation of Turks living in Germany still continue to choose their spouses from Turkey. We should prevent this because it inhibits integration.
This act is interpreted as Germanys observing itself as a country of emigration.
The regulations foreseen by said act are as follows:
Family unification: The spouses of business people and the citizens of countries with whom Germany has business relations are exempted from the stiffening of the act. So a road is opened to direct the more elite people to migrate to Germany.
The spouses who want to come to Germany should be above 18. This is meant to prevent obligatory marriages. The most important restriction is made in the field of language. According to this act spouses who want to comet to Germany by way of marriages should have an elementary knowledge of German grammar.
One needs to know 200-300 words. Those who cant speak German will not be given a visa. This obligation is in fact opening the way violation of a basic human right which is family unification. Another important subject about family unification is that the spouse who demands for family unification should prove how he/she will make a living, but this is not required if the spouse is German.
Permission of residence: From the beginning, people with qualifications have the right to work and reside in Germany for unlimited times. Members of their families have the right to work as well. Those who come to Germany and make an investment of at least l.000.000 and employ at least 10 people are given a limited permission of residence. After university graduation, students may stay in Germany for a year to look for a job.
Citizenship: The conditions to acquire citizenship are meant to be made identical over the country. Something similar to the citizenship test which some states apply will be valid uniformly in the country. Adequate knowledge of German language, commitment to the Constitution and compatibility to the social order will be obligatory.
One who wants to acquire citizenship will have to confirm his/her knowledge of written and oral language by presenting a certificate. This condition will be a problem for immigrants who are semi-qualified or unqualified employees. One who wants to acquire citizenship is expected to be informed of the living conditions in Germany.
Integration courses: The quantity and the quality of the integration courses put in practice will be increased as soon as the Immigration Act goes into effect. The courses will continue to be for 630 hours.
Those who refuse to participate in the courses will be punished to pay .1.000.000 and will be deported if necessary. Social Offices, Work Offices and Youth Offices will inform Foreigner Offices of those who are not inclined to be oriented.
The right of residence of refugees: Starting from July 1, bachelors living in Germany for at least 8 years, married people with a child living in Germany for at least 6 years may apply for the right of permanent residence.
For a temporary residence to be transformed into a permanent residence, the refugee is required to earn his/her living, should speak German and be in conformity with the society. At the end of the temporary residence which will be valid until the end of 2009, those who want to apply for a permanent residence must earn their own living.
Furthermore, for foreigners from non-EU countries, the time limit for free work in markets is changed from 3 years to 4 years.
If we make a general evaluation of Immigration Act, we observe that an elastic concept that takes Germanys need for labour power into consideration has become dominant as a fundamental concept. With this new act the migration of high quality labour power which the markets need is made easier.
Instead of making the unemployed workers qualified, effort is made to make a mass of labourers from other countries to come and work for low wages. This is a potential subject for a crisis between Germans and foreigners.
